AppGaps Terms of Service

These Terms of Service (“Terms”) govern your use of the AppGaps mobile application (the “App”), operated by Aybini Investments LLC (“AppGaps,” “we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement.

2. What AppGaps Does

AppGaps analyzes publicly available App Store reviews for apps you select, using AI (via Anthropic's Claude API) to identify recurring user complaints, themes, and potential product opportunities. AppGaps is an analytical and informational tool only.

AppGaps does not provide business, financial, investment, or legal advice. The insights, “Gap Scores,” “Opportunity Scores,” “Buildability Scores,” and similar AI-generated content are automatically derived from a limited sample of public review text and are provided for informational and exploratory purposes only. They are not guarantees of market opportunity, product success, revenue potential, or business outcome of any kind. You are solely responsible for any business, product, or investment decisions you make, and should conduct your own independent research and consult qualified professionals as appropriate before acting on any information the App provides.

3. Accounts

• You may use core features of the App anonymously without creating an account.
• Certain features (saving niches/opportunities, Watchlist, notifications, and Pro subscription access) require signing in with your Apple ID via “Sign in with Apple.”
• You are responsible for maintaining the security of your Apple ID and for all activity that occurs under your account.
• You may delete your account and associated data at any time via Profile → Delete Account in the App.

4. Subscriptions

• AppGaps offers a free tier (limited to one real analysis) and a paid “AppGaps Pro” subscription, currently offered at $9.99/month or $29.99/year (prices subject to change; the current price is always shown in the App before purchase).
• Subscriptions are billed through your Apple ID account and are subject to Apple's standard subscription terms.
• Auto-renewal: subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Cancellation: you can cancel your subscription at any time via your device's Settings → [Your Name] → Subscriptions. Canceling stops future renewals but does not refund the current billing period.
• Refunds: refund requests are handled by Apple in accordance with Apple's standard App Store refund policies; AppGaps does not directly process payments or issue refunds.
• Deleting your AppGaps account (in-app) does not cancel an active subscription — subscriptions must be canceled separately through Apple.

5. Acceptable Use

You agree not to:

• Use the App to attempt to access, scrape, or extract data from our backend outside of the App's normal functioning (e.g., via reverse engineering, automated scripts, or bypassing App Check/authentication protections)
• Use the App for any unlawful purpose or in violation of any applicable law
• Attempt to circumvent free-tier usage limits through multiple accounts, automation, or other abusive means
• Interfere with or disrupt the App's servers or networks

We reserve the right to suspend or terminate access for any account that violates these Terms.

6. Intellectual Property

• The App, its design, branding, and underlying software are owned by Aybini Investments LLC and protected by applicable intellectual property laws.
• App Store review content analyzed by the App remains the property of its original authors and Apple; AppGaps claims no ownership over third-party review text, only over the AI-generated analysis and insights derived from it.
• You may not copy, modify, distribute, or create derivative works of the App or its content without our prior written permission.

7. AI-Generated Content Disclaimer

Insights, summaries, scores, and suggested “product directions” generated by the App are produced by AI language models based on a limited sample of public review data. This content:

• May contain inaccuracies, omissions, or outdated information
• Should not be relied upon as the sole basis for any business, financial, or strategic decision
• Does not constitute professional advice of any kind

8. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY INSIGHTS PROVIDED WILL BE ACCURATE OR COMPLETE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AYBINI INVESTMENTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ANY CONTENT IT PROVIDES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties. You may stop using the App and delete your account at any time.

11. Changes to the App or These Terms

We may modify or discontinue the App, or any part of it, at any time. We may update these Terms from time to time; continued use of the App after changes take effect constitutes acceptance of the updated Terms.
